Husband and wife do not want to have the right to annul the marriage because of the fault of the other, no matter how serious the fault. Such as insanity, white leprosy, toilet, urinal, etc.

The second group is the ones that have the power to annul the marriage of both the spouses due to any defect in the relationship between the husband and wife. Such as insanity, whiteness, leprosy, foul smelling mouth, various kinds of hateful diseases and genital defects that interfere with intercourse. This is the madhhab of Imam Malik (ra).

If one of these defects exists between a man or a woman, then the other has the right to be with him or to separate from him.

According to Imam Shafi'i, in case of insanity, leprosy and leprosy, both husband and wife have the power to annul the marriage. But the wounds of the place of shame, from which there is always dripping, bad breath, itching, etc., do not have the authority to annul the marriage. However, if the woman has a disease inside the body that interferes with intercourse, or if the man is impotent or cut-penis, then the other party has the power to annul the marriage.

According to Imam Muhammad (pbuh), the husband does not have the authority to annul the marriage on the basis of any physical defect of the wife. But in case of insanity, leprosy, etc. of the husband, the wife has the power to annul the marriage.

The second of these schools is closer to the teachings of the Qur'an. According to the Qur'an, both the marital relationship between a man and a woman are important in terms of purpose. The protection of one character and morality is love and harmony between two husbands and wives.

Both of these motives are thwarted by the existence of the aforesaid faults. As a result, the husband and wife are naturally forced to hate each other or cannot meet each other's natural needs. As we have already explained, it is one of the basic tenets of Islamic marriage law that marital relations should not be harmful to the husband and wife and should not be a cause of transgression of the limits set by Allah.

This policy is disrupted if the power to annul the marriage is not exercised due to the aforesaid faults. All of the diseases mentioned above are harmful and as a result there is a danger of violating the limits set by Allah due to hatred of one of the spouses or non-fulfillment of one's sexual needs. Therefore, the power to annul the marriage should be reserved for the husband and wife due to all the ailments and faults mentioned above.
