From the point of view of this verse, the husband has no right to inflict any kind of harshness or torture on his wife without any valid reason, whether it be physical or verbal abuse. If he does, the wife has the right to seek legal redress.

We did not know any detailed instructions in this regard. But we think that there is such a connection between the principles of Islamic law that the Qazi can be given the power to protect women from such torture and to divorce them in case of unbearable torture. Nowadays we see a common practice of treating women unfairly at different levels.

Homosexuality is thought to mean unlimited free license to torture and coercion. To curb this trend, it is very important to enact new sections of the law. If nothing else, it is necessary to at least say that the practice of harassment and swearing should be considered as one of the legitimate reasons to claim openness. If such a bad habit is proved against a husband, then his wife should be allowed to open it without any exchange.

The Panha that Hazrat Al (RA) has adopted in this case shows us the right path. Kashful Gummah mentions that when the case of a man and his wife was presented to his court, he ordered, according to the instructions of the verses of the Qur'an, both of them to be arbitrators one by one.

He then addressed the two arbitrators and said that it was your job to reconcile the two. He then asked the woman if she was willing to accept the decision of the two arbitrators. She said yes. He said if they compromised between us then I would accept their decision.

And if they separate, I will not obey. In this context, he said. You don't have that right. You will not be able to move a single step from this place unless you express your consent like that woman.

In the case of such marital disputes which are not related to the larger and more important legal issues, it is best to adopt this method of settlement. In this regard, it is necessary to add some sections in the law which will include the power of arbitrators to implement their joint decision and a detailed explanation of the jurisdiction of the court in case of dispute.

It is a very valuable provision in Islamic law that family disputes should be avoided in public court as much as possible. If such a case comes up in the court, the judge will seek the help of the responsible persons of the family of both the spouses to resolve the issue before inquiring and deciding on the matter. This proposal should be considered as a blessing for social life.
